EuroKids Limited    -    Terms and Conditions for clients

EuroKids Limited acts as an employment agency.

Working Day
Normal rates will apply to bookings between 09.00 hours and 18.00 hours.  All fees are based on the following:

Minimum booking time — 1 hour
Half day — 4 hours  (Pre-Booked)
Full day — 8 hours  (Pre-Booked)
Provisional bookings will be automatically cancelled if they are not confirmed within 24 hours of the proposed booking, or if another definite booking is offered and the provisional cannot be confirmed.

Overtime Rate   -  Over time rates apply outside 09.00—18.00 on all bookings over 8 hrs
Rates when out of  09.00 to 18.00
1.5 times the normal rate between 18.00 and 24.00. A special rate is negotiated for night work between 24.00 and 09.00
Saturdays   -  1.5 times the normal rate
Sundays/Bank Holidays  -  2.0 times the normal rate

Travel Rate
Travel rates, if applicable, will be negotiated at time of booking.

Additional Fees
To be agreed at time of booking:

Additional fees are payable for the right to use the photographs (or reproductions, or adaptations of , or drawings there from, either complete or in part, alone or in conjunction with any wording or drawings, including electronic imaging) for all known or anticipated purposes other than the initial permitted use (e.g.:  Show- cards, swing tickets, posters, record covers, packaging, packs etc ).  The additional fees cover the right to use one image for one year in the UK alone. 

To be agreed after the time of booking:
It is the clients responsibility to notify the agency and negotiate additional fees (including extensions of existing agreements)  for any further additional usage in the UK, and for all known or anticipated territories outside the UK, which may be required or anticipated subsequent to the time of booking.

Exclusion Fees
A special fee will be negotiated when the work is in conjunction with a product which precludes work for competing products.  It is the clients responsibility to check whether conflicting work has been done.  If a model advertises a product he/she is able to work for any competitor unless an exclusion fee is negotiated.

Test & Experimental Photography & Commercials
A photographer is not entitled to use test and/or experimental photographs or test commercials  for commercial purposes unless specific arrangements have been made in writing with the agency prior to the test.

Complaints
Any cause for complaint should be reported to the Agency when it arises.  Complaints cannot be considered in retrospect.

Insurance / Health & Safety
The client is responsible for the models health & safety when the model is travelling, or providing services in connection with the booking.  If the model is modelling equipment/products of any form or on location it is the client’s responsibility to ensure that these meet Health & Safety standards.  The client will maintain adequate insurance cover to underwrite its obligations to the model.

The agency is not responsible if the model fails to attend the booking or cancels the booking.  The client is advised to insure against any losses which might result if the model does not keep a booking or some other reason.  The agency is not responsible if the model fails to complete a booking to the client’s requirement.   The client is advised to insure against any losses which might result if the booking needs to be re-shot because of the model’s ill health or some other reason.

N.N.C.E.E.
EuroKids Limited is a member of the National Network for Children in Employment & Entertainment and acts as an employment agency to models, actors & artists.   The client is the employer and therefore is responsible to adhere to the legislation in accordance with the ‘Children & Young Person Act 1933 & 1963 and the Children (Performances) Regulations 1968’ and is solely responsible for the models, actors and artists welfare whilst providing services in connection with the booking.

Payment
1. Payment is required 60 days from the date of invoice.  A 10% credit charge per month may be added to all invoices not settled within payment terms.
2. In all cases the Client responsible for commissioning the session will be invoiced, and be solely responsible for payment unless otherwise agreed in writing at the time of booking.  All fees are for the right to use pictures and, once agreed, are payable whether or not the use is appropriated.  All fees quoted are for the U.K. only  -  unless otherwise agreed when booking is made. 

Cancellation Fees
If a booking is cancelled within one working day of the starting time the full fee may be charged unless the same model is re-booked within 24 hours in which case half the fee may be charged. If a booking is cancelled outside the one day period but within two working days of the starting time, 50% of the fee of the fee may be charged.  Bookings of more than 3 days duration:  If the booking is cancelled within a period equal to the length of the booking, then half the fee may be charged. These cancellation fees may be incurred at the discretion of the agency.

Weather Permitting Bookings
Cancellations are at full fee if the model arrives at the booking venue.

Television, Film & Video work, excluding equity rates, are negotiated with the agency at time of booking
Please note:
1.               All fees to be negotiated only with EuroKids Ltd
2.               It is not permitted to use photographs or any other form of material supplied by EuroKids Ltd until all fees have been paid to   EuroKids  Ltd
3.               Whilst every endeavour is made to provide a satisfactory and  efficient service to the client we can not be held responsible for a models conduct on an assignment.
4.               EuroKids Ltd reserves the right to negotiate within the structure of these terms and conditions.

It is agreed by the client that on hiring a model, actor or supporting artist from EuroKids Limited that they agree and abide to all the terms & conditions as above.
